These Terms and Conditions govern your use of the website operated by Serendipity (the “Website”) and any purchase of goods made via the Website or in our physical shop in Bovey Tracey, Devon (the “Shop”). By using the Website and/or placing an order with us, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Website or purchase goods from us.
In these Terms and Conditions, “Serendipity”, “we”, “us” and “our” refer to the business trading as Serendipity in Bovey Tracey, Devon, United Kingdom. Our contact details, including trading address, email address and telephone number, will be displayed on the Website and in the Shop once confirmed.
You must not misuse the Website or introduce any virus, trojan or other malicious or technologically harmful material. You must not attempt to gain unauthorised access to the Website, the server on which it is stored or any server, computer or database connected to the Website. All text, images, graphics, logos and other content on the Website are owned by or licensed to Serendipity and are protected by intellectual property laws. You may not copy, reproduce, modify, distribute or exploit any content without our prior written consent, other than for personal, non commercial use.
We take reasonable care to ensure that product descriptions, images and pricing are accurate at the time they are entered onto the Website. However, minor variations may occur. Colours can appear differently on different screens and devices and natural variations may occur in fabrics and other materials. All measurements, including fabric lengths and widths, are approximate unless expressly stated otherwise.
By placing an order on the Website, you are making an offer to purchase goods from us. After placing an order, you will receive an email acknowledging that we have received your order. This acknowledgement does not mean that your order has been accepted. A legally binding contract between you and Serendipity is formed only when we dispatch the goods and send you a dispatch confirmation email. We reserve the right to decline any order prior to dispatch.
All orders are subject to availability. If an item becomes unavailable after you have placed an order, we will contact you as soon as reasonably possible to offer an alternative, a revised delivery time or a refund.
Prices are shown in pounds sterling (GBP) and include VAT where applicable, unless clearly stated otherwise. We take reasonable care to ensure that prices are correct at the time they are entered on the Website. If we discover an error in the price of goods you have ordered, we will inform you as soon as reasonably possible. You will then have the option to reconfirm the order at the correct price or cancel your order. If we are unable to contact you, we will treat the order as cancelled and refund any sums paid. Payment is due in full at the time of ordering online. Payments are processed securely by our chosen payment service providers. We do not store full payment card details on our systems.
Delivery options, charges and estimated timescales are set out in our Delivery Information and are incorporated into these Terms and Conditions by reference. We will deliver goods to the address you specify when placing your order. You are responsible for ensuring that the delivery address and contact details are accurate and complete. Risk of loss or damage to the goods passes to you when they are delivered to you or to a person you nominate to receive them on your behalf.
Where a click and collect service is offered, you will be notified when your order is ready for collection from the Shop. You must bring proof of purchase and any identification we reasonably request.
Your legal rights in relation to goods are set out in the Consumer Rights Act 2015. Goods must be as described, of satisfactory quality and fit for any purpose made known to us. If goods are faulty, you may have a right to a repair, replacement or refund, depending on the circumstances and the time that has passed since purchase. Your cancellation rights for distance and off premises contracts, such as online orders, are explained in our Returns and Refunds Policy and are in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Certain goods, including fabric cut to your requested length and other customised or personalised items, are made or altered to your specification. These goods are exempt from the usual right to cancel for distance and off premises contracts, except where they are faulty or not as described.
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law. Subject to this, we shall not be liable for any loss of profits, loss of business, loss of data, or any indirect or consequential loss arising out of or in connection with your use of the Website or the purchase or use of any goods supplied by us. Our total liability to you in respect of any claim arising out of a contract for goods shall be limited to the price paid for those goods.
We may update these Terms and Conditions from time to time. Any changes will be posted on the Website with an updated “Last updated” date. The terms in force at the time you place your order will apply to that order.
These Terms and Conditions and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, although if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland you may also bring proceedings in Scotland.
